Máximo Kirchner tiene luz verde para presidir el PJ
El magistrado consideró que el intendente no agotó la instancia partidaria al no recurrir al congreso provincial del partido.
El juez federal con competencia electoral, Alejo Ramos Padilla, rechazó el pedido de nulidad presentado por Fernando Gray para suspender las elecciones del PJ bonaerense y ahora Máximo Kirchner tiene luz verde para asumir en la presidencia del partido.
Ramos Padilla, titular del Juzgado Federal 1 de La Plata, rechazó el planteo de nulidad de la reunión del Consejo Provincial del Partido Justicialista que se reunió el pasado 27 de febrero
El magistrado expresó en el fallo que Gray no agotó la instancia partidaria, toda vez que no recurrió al congreso partidario (el órgano máximo) previo a la instancia judicial, tal como lo exige el artículo 57 de la Ley de Partidos Políticos.
Ramos Padilla sostiene que la disconformidad con la vía elegida para la convocatoria y celebración de la reunión «son debatibles dentro del seno del partido, pero no habilitan la intervención judicial».
Tampoco surge de la presentación de Gray que quienes votaron, quienes se abstuvieron, y quienes no participaron de la reunión «lo hayan hecho en forma contraria a su voluntad y decisión» sino que, según las pruebas aportadas, se advierte que se instrumentaron todos los medios posibles para superar las dificultades técnicas que tuvieron algunos consejeros. El juez argumenta que quienes no pudieron validar su identidad, tuvieron la posibilidad de votar a viva voz, ante la cámara, con identificación del consejero votante.
«En definitiva, de 48 miembros que integran el Consejo Provincial del Partido Justicialista, participaron de la reunión 43, votaron a favor de la convocatoria a elecciones internas 41 Consejeros y sólo se registraron 2 abstenciones y 5 ausentes», dice Ramos Padilla.
La semana pasada, el fiscal federal Guillermo Ferrara le pidió a Ramos Padilla, que acepte el pedido del intendente de Esteban Echeverría y suspenda las elecciones internas del Partido Justicialista, al considerar que no hay motivos fundados para anticipar los comicios.
En ese fallo, el fiscal subrogante consideró en un dictamen que ni la convocatoria vía WhatsApp ni la reunión virtual del Consejo son cuestionables, pero hizo foco en las razones del adelantamiento de las elecciones.
Gray viene resistiendo en soledad la llegada de Máximo a la presidencia del PJ bonaerense. Sucede que el alcalde de Esteban Echeverría debía completar en diciembre su mandato en la presidencia rotativa del partido que asumió junto a su par de Merlo, Gustavo Menéndez.
Además de su avanzada judicial, el intendente viene realizando en las últimas semanas una serie de acciones mediáticas para resistir la llegada de Máximo. El fin de semana grabó un spot desde la terraza del ministerio de Desarrollo Social, aquel viejo Ministerio de Obras Públicas emplazado en la 9 de Julio, donde Evita hizo su renunciamiento histórico. Allí, desplegó la bandera del Partido Justicialista.
