Alberto Fernández presentará en la Casa Rosada su reforma judicial
Se trata de una iniciativa política que apunta a licuar la influencia de Comodoro Py, crear 34 nuevos juzgados federales y revisar el funcionamiento del Alto Tribunal por medio de una Comisión de Asesores que incluye al abogado defensor de Cristina Fernández de Kirchner.
El Salón Blanco de la Casa Rosada fue el escenario de poder que eligió Alberto Fernández para anunciar hoy su reforma judicial que apunta a revisar el funcionamiento de la Corte Suprema y a licuar el poder de los jueces de Comodoro Py que investigan importantes casos de corrupción pública.
La iniciativa oficialista ya fue rechazada de hecho por la mayoría de la Corte Suprema, que optó por esquivar la invitación presidencial y faltar a la cita para exhibir sin atenuantes su vacío institucional a una eventual reforma que apunta al sistema de equilibrio de poderes.
En este contexto, y pese a sus diferencias personales e ideológicas, Carlos Rosenkrantz, Ricardo Lorenzetti, Horacio Rosatti y Juan Carlos Maqueda coincidieron en descartar la participación del acto protocolar que fue convocado para las cuatro de la tarde. Apenas Elena Highton de Nolasco, que acostumbra a concurrir a todas las ceremonias oficiales, se sentará en primera fila para escuchar al jefe de Estado.
Pero la mayoría de la Corte no está sola en su rechazo a la propuesta judicial del Frente de Todos. La oposición política liderada por Mauricio Macri, Alfredo Cornejo, Elisa Carrió, María Eugenia Vidal, Horacio Rodríguez Larreta, Miguel Ángel Pichetto, Mario Negri y Christian Ritondo, entre otros, firmaron un documento público que criticó la iniciativa legislativa que ingresará al Congreso en los próximos días.

La reforma judicial que rechaza la mayoría de la Corte y la oposición política apunta a crear nuevos juzgados federales con el objetivo de licuar el poder los jueces de Comodoro Py y la puesta en marcha de un consejo asesor de 11 juristas que analice el funcionamiento de la Corte Suprema de Justicia de la Nación y presente posibles reformas, entre ellas la cantidad de sus integrantes.
La ceremonia oficial tendrá invitados presenciales y virtuales, entre ellos los integrantes del Consejo de la Magistratura de la Nación y los miembros de la Comisión de Asesores que fueron elegidos por el Presidente y Cristina Fernández de Kirchner. También está previsto que concurran la ministra de Justicia y Derechos Humanos de la Nación, Marcela Losardo, el secretario de Asuntos Estratégicos, Gustavo Béliz, y la secretaria Legal y Técnica, Vilma Ibarra.
Alberto Fernández será el único orador de la presentación oficial. Y anoche aún no estaba confirmada la presencia de CFK.
La iniciativa tiene como aspecto central reformar la justicia federal de la Capital Federal. Es lo que públicamente se conoce como los tribunales de Comodoro Py porque están a la altura del 2002 de la avenida con ese nombre en el barrio de Retiro. Por allí pasan todas las causas que involucran al poder político y económico, las de corrupción y las que involucran a los funcionarios públicos.
El proyecto, según lo que se conoce y que publicó Infobae hace una semana, buscará pasar de los actuales 12 juzgados federales de primera instancia a 46. Para llegar a ese número eso unificará el fuero Penal Económico, que tiene 11 juzgados de primera instancia, con los 12 de Comodoro Py. Así, serían 23 juzgados pero cada una de las dos secretarias judiciales que tienen pasaría a ser un juzgado, por lo que quedan 46. El nombre del nuevo fuero será el de Penal Federal.
Con la unificación, el nuevo fuero tendrá los temas de investigación que antes tenía cada uno por separado. Además de las causas de corrupción Comodoro Py investiga el crimen organizado, el narcotráfico, los secuestros y la trata de persona, entre otros temas. Por su parte, Penal Económico lleva los casos de contrabando y de violaciones a la Ley Penal Tributaria.

La reforma le permitiría al Gobierno designar a la mitad de los jueces del nuevo fuero. Primero porque se abren 23 nuevos cargos de magistrados. Pero también por las vacantes que hay actualmente en los tribunales de Comodoro Py y en Penal Económico. Infobae contó esta semana que en Comodoro Py hay 16 vacantes entre jueces y fiscales, algunos lugares en los que se puede definir el futuro de una causa o de alguno de sus acusados. Y en Penal Económico los lugares libres hoy son cinco de magistrados -tres de ellos en la Cámara- y cuatro fiscales.
Hasta que los 23 juzgados nuevos que crea el proyecto sean ocupados por sus titulares la iniciativa prevé que estén al frente jueces subrogantes. Puntualmente que sean magistrados del fuero de instrucción -la justicia penal ordinaria que investiga robos, violaciones, homicidios- que quieren ocupar esos lugares. Deberán anotarse en una lista que analizará el Consejo de la Magistratura de la Nación que aprobará y enviará al Poder Ejecutivo. Y de allí al Senado para su aprobación final.
Para la justicia federal de las provincias la reforma plantea duplicar los juzgados de primera instancia. Hoy todos tienen la competencia múltiple: penal, civil, comercial, laboral, contencioso administrativo. La idea es que haya un juzgado penal y otro para el resto de los temas.
El proyecto tiene una segunda fusión de fueros. Es la unión de la justicia Civil y Comercial Federal con la Contencioso Administrativo Federal. Son los tribunales donde se tramitan las causas en las que el estado es demandado o parte. El nuevo fuero se llamará Civil, Comercial y Contencioso Administrativo Federal.
La reforma contempla otros aspectos como concretar el traspaso de la justicia penal de instrucción a la ciudad de Buenos Aires y acelerar en todo el país la puesta en marcha del sistema acusatorio, en el cual los fiscales son quiénes llevan adelante las investigaciones penales.

El anuncio del Presidente también contendrá la creación de un consejo asesor para que analicen el funcionamiento de la justicia para presentar propuestas de reforma. Estará integrado por 11 juristas , entre ellos Carlos Beraldi, abogado de la vicepresidenta Cristina Kirchner, el ex juez federal y ex ministro de Justicia León Arslanián, la jueza de la Suprema Corte de Justicia de la provincia de Buenos Aires Hilda Kogan y la integrante del Superior Tribunal de Justicia de la ciudad de Buenos Aires Inés Weinberg de Roca, quien había sido propuesta por Mauricio Macri para ser procuradora General de la Nación y cuyo pliego no prosperó.
Uno de los aspectos centrales de la comisión será su mirada sobre la Corte Suprema de Justicia de la Nación. Tanto sobre la cantidad de integrantes -hoy sin cinco- como si debe o no ser dividida en salas de especialidades. “Yo pienso que no debe aumentarse el número de miembros de la Corte pero me gustaría escuchar a gente experta”, dijo Fernández en mayo pasado en un reportaje con el canal de noticias C5N. Uno de los flamantes integrantes de la comisión, el abogado constitucionalista Andrés Gil Dominguez, adelantó que su opinión es que el máximo tribunal debe estar integrado por nueve jueces.

“La Corte Suprema como ideal tiene que ser de 9 miembros y no la podés dividir en salas. Hay que mejorar el funcionamiento del acceso y de las causas que la CSJN resuelve. Son temas críticos, especialmente el funcionamiento, porque recibe entre 23 y 24 mil causas por año, de las cuales rechaza el 90% mediante la invocación de un artículo del Código Procesal Civil y Comercial”, dijo ayer Gil Domínguez en declaraciones a FutuRöck.
El consejo asesor también analizará el funcionamiento del Consejo de la Magistratura de la Nación. Su texto de creación definirá la forma de trabajo del consejo y el plazo que tenga para presentar sus conclusiones, que no serán obligatorias de seguir para el gobierno.
El debate por la reforma
El proyecto de reforma judicial será enviado al Congreso de la Nación donde se tratará la iniciativa. Juntos por el Cambio, el mayor bloque de la oposición, ya adelantó su rechazó a una eventual ampliación de la Corte Suprema y a los principales lineamientos de la reforma.
Fue en una reunión que ayer tuvieron los presidentes de los tres partidos de la coalición, Patricia Bullrich, Alfredo Cornejo y Maximiliano Ferraro; los líderes parlamentarios Mario Negri, Luis Naidenoff, Cristian Ritondo, Juan López y Maricel Etchecoin; junto al ex presidente Mauricio Macri, el jefe de gobierno porteño Horacio Rodríguez Larreta y la ex gobernadora María Eugenia Vidal.

A través de un comunicado, Juntos por el Cambio sostuvo que esos temas “no son una prioridad para la ciudadanía preocupada por angustias y carencias evidentes en materia económica, social y de seguridad” y que “la estabilidad en el tiempo del máximo tribunal es un valor en sí mismo, que resguarda la independencia del Poder Judicial, la seguridad jurídica y en definitiva la calidad democrática y de las instituciones de nuestra República”.
“Que participe el abogado de Cristina Kirchner hace mucho ruido, como así también la cantidad de especialistas en derecho penal. No hay expertos en el Ministerio Público ni en el funcionamiento del Consejo de la Magistratura”, fueron otras de las críticas que esbozó uno de los participantes de la reunión.
Alberto Fernández pretende que su reforma judicial sea sancionada antes de fin de año. Se trata de una compleja aspiración política: sin el respaldo de la Corte y de la oposición, todo será cuesta arriba y con final incierto.
