Caso Báez Sosa: la defensa de los rugbiers insiste con las nulidades y el homicidio en riña
Fuentes judiciales informaron en la mañana de hoy, que la defensa de los ocho patoteros de Zárate, condenados por el crimen de Fernando Báez Sosa, ocurrido en la madrugada del 18 de enero de 2020 en la localidad balnearia de Villa Gesell, también presentó el recurso de apelación ante el Tribunal de Casación bonaerense, donde insistió con planteos de nulidades, con la figura del “homicidio en riña” para los condenados a prisión perpetua y con la absolución de los tres partícipes secundarios.
De la misma manera en que los fiscales del juicio ya solicitaron ante el mismo tribunal de alzada que los ocho jóvenes condenados sean considerados coautores del “homicidio agravado” de Fernando y condenados a perpetua. El defensor Hugo Tomei presentó esta mañana su apelación para revertir la sentencia del Tribunal Oral en lo Criminal N° 1 de Dolores.
En primer término, y tal como ya lo había planteado en la instrucción del caso y durante el debate, Tomei pidió que se declare “la ilegalidad” del acto de las indagatorias tomadas a los ocho acusados la noche del 19 de enero de 2020.
La defensa había planteado en ese procedimiento, “falsificaron las actas del expediente entre fiscal, la defensora oficial y dos secretarios del Ministerio Público Fiscal”.
En otro punto, la defensa requirió que se declare la “parcialidad” de los jueces integrantes de la Sala 1 de la Cámara de Apelaciones y Garantías de Dolores que el 14 de abril de 2020 confirmaron las prisiones preventivas para los acusados.
La defensa justificó el planteo en que en aquella resolución, los camaristas Luis Felipe Defelitto, Fernando Sotelo y Susana Yaltone llamaron a los imputados “mentirosos, fríos, calculadores, que salieron de cacería humana y que eran poseedores de una maldad inhumana”.
El abogado defensor reiteró uno de los planteos centrales de su alegato en el juicio, al sostener que se violó “el principio de congruencia” en la sentencia porque, a su criterio, sus clientes llegaron al debate con una acusación genérica y la fiscalía modificó los hechos con una imputación más detallada.
En relación a los tres condenados a 15 años de cárcel como “partícipes secundarios” del crimen (Blas Cinalli, Ayrton Viollaz y Lucas Pertossi, el abogado le pidió al Tribunal de Casación que sean absueltos.
Y respecto a los cinco sentenciados a perpetua, es decir, Máximo Thomsen, Enzo Comelli, Matías Benicelli y Luciano y Ciro Pertoss, su defensor cuestionó la calificación de “homicidio agravado por alevosía y por el concurso premeditado de dos o más personas” por la que fueron condenados.
Por ello, insistió con que en todo caso cometieron un “homicidio en agresión tumultuosa”, delito contemplado por el Artículo 95 del Código Penal y que tiene una pena claramente inferior, que va de los dos a los seis años de prisión.
