Condenaron a prisión en suspenso a un intendente salteño

Por crear una aduana clandestina.

Fue inhabilitado por un año por violación de los derechos de funcionario público en la frontera caliente, por habilitar un paso clandestino de ingreso al país.

La Justicia Federal condenó al intendente de Aguas Blancas, Sergio Oliva, a la pena de 6 meses de prisión en suspenso, inhabilitación especial por el doble tiempo de la condena y costas, por ser autor penalmente responsable del delito de violación de los deberes de funcionario público (arts. 20, 26, 40, 41 y 248 del C.P.).

Asimismo, se le imponen las siguientes reglas de conducta: deberá fijar residencia y comunicar al Tribunal en caso de querer ausentarse del país, abstenerse de usar estupefacientes o de abusar de bebidas alcohólicas y no cometer nuevo delito, todo ello por el tiempo que dure la condena (art. 27 y 27 bis C.P.).

Las actuaciones se originaron a raíz de una denuncia del Jefe del Escuadrón 20 “Oran” de Gendarmería Nacional, Cte. Ppal. Cesar Miguel Arias, en razón de que a través de Nota N° 510/2016 del administrador de la División Aduana de Orán, Edgardo Enrique Beretta, tomó conocimiento de que en fecha 29/04/2016 en horas de la tarde noche, personal de Aduana observó una máquina retro-excavadora, contratada por el Municipio de la localidad de Aguas Blancas, realizando trabajos de apertura de una calle hacia la vera del rio Bermejo en cercanías al “ACI CHALANAS” […[ y en consecuencia, se habilitó una suerte de paso clandestino con acceso directo al territorio argentino.

Según expresa el fallo, se pudo comprobar que Oliva, en su carácter de intendente de Aguas Blancas, autorizó la apertura de una calle lateral al puesto de control integrado y denominado como “Puesto de Control Integrado Chalanas”, sin haber hecho el requerimiento y posterior aprobación de los permisos que se deben solicitar oportunamente a la Comisión Nacional de Zonas de Seguridad, contrariando con su conducta una ley de la Nación.
