Corrupción: le quitan una mansión a un ex intendente kirchnerista

Mendoza avanza contra la corrupción con un fallo histórico.

Por primera vez en el país, la Justicia le quitó bienes a un exintendente kirchnerista en un juicio de Extinción de Dominio realizado en el fuero civil. En tanto, en los tribunales penales continúan las causas en su contra por enriquecimiento ilícito.

Se trata de Luis Lobos, excacique justicialista de Guaymallén, la comuna más poblada de Mendoza, quien junto a su esposa perderán una serie de propiedades que tenían en su poder, ya que no lograron justificar el origen de los fondos, vinculados a actos contra la administración pública.
Así, tal como estipula la Ley 9.151, parte del patrimonio del exjefe comunal pasará a la provincia, que deberá instrumentar los medios necesarios para destinar los recursos obtenidos a la educación mendocina; esto es mejorar la infraestructura de las escuelas locales.
«Admitir parcialmente la acción de extinción de dominio incoada en autos por el Ministerio Público Fiscal de la Provincia de Mendoza y, en consecuencia, declarar extinguido el dominio de los Sres. Luis Alberto Lobos y Claudia Verónica Sgro respecto de los siguientes bienes», señala el escrito de la jueza María Paz Gallardo, del Primer Tribunal de Gestión Asociada.
En este sentido, la Justicia avanza sobre dos inmuebles, uno de ellos considerado una mansión familiar, ubicada en la calle Tirasso 4.357 de Guaymallén.

En tanto, se desestimó la acción de extinción de dominio sobre vehículos que ambos tienen en su haber: un Peugeot 308, un Volkswagen Amarok 2.0 y un cuatriciclo Can-Am.
El actual intendente de Guaymallén, Marcelino Iglesias, uno de los referentes del radicalismo local, cargó contra el cuestionado cacique y celebró la decisión de la Justicia civil. «Hubo una banda de enriquecimiento ilítico. Es un mensaje de que no se puede robar impunemente. Es un precedente fantástico a nivel nacional».
En tanto, en diálogo con La Nación, el subsecretario de Justicia de Mendoza, Marcelo D’Agostino puso de relieve el fallo. «Marca un precedente para los funcionarios que han adquirido bienes a partir de la corrupción; antes se necesitaba que hubiera sentencia firme.

Pasaba mucho tiempo y los bienes permanecían en manos de los delincuentes», indicó el funcionario, y destacó: «Es la primera sentencia ante un delito de corrupción en la administración pública. Antes sólo se había aplicado la extinción de dominio para casos de narcotráfico».
Mientras, en el peronismo acusaron recibo del golpe judicial y se limitaron a decir que el justicialismo «pagó y sigue pagando ese costo».

Al mismo tiempo, indicaron que a partir de ahora «ya no hay ningún costo nuevo; cero por ciento», entendiendo que los mendocinos «ya sabían cómo iba a terminar Lobos por todo lo que hizo».

La norma de Extinción de Dominio fue sancionada en el 2019 durante la gestión del ex gobernador Alfredo Cornejo la cual dispone que los bienes malhabidos pueden ser rematados y puestos a disposición de Tesorería de la Provincia para volcarlos a la comunidad educativa en el arreglo de las escuelas, como una forma de resarcimiento a la ciudadanía por el desmanejo de los fondos públicos, independientemente de que las causas penales no hayan concluido.

De esta manera, la Justicia civil comprobó que el exintendente se benefició del erario público durante su gestión municipal, entre 2011 y 2015, siendo además cuestionado constantemente por los vecinos ante el incumplimiento de las promesas de concreción de obra pública.
Lobos tiene en su contra un proceso penal, sin resolución firme, por fraude a la administración pública que llegó a la Suprema Corte de Justicia de Mendoza.
Fue condenado a 4 años de prisión por ser el responsable de contratar en la comuna a empleados personales, a quienes le retenía además parte del sueldo. En tanto su mujer fue sentenciada a 3 años y 4 meses de cárcel.
Asimismo, la causa por enriquecimiento ilícito, vinculada a la resolución civil, sigue su curso y se espera que en los próximos meses se siente nuevamente en el banquillo de los acusados.
