Cristina Kirchner rompe puentes en el Senado

Ya habían pasado las dos de la madrugada del viernes cuando Sergio Massa chocó su codo con el de Máximo Kirchner. Durante veinte minutos conversaron sobre los efectos económicos de la pandemia (como la fuerte caída de la recaudación) más que sobre la extensa sesión que acababa de terminar tras nueve horas y 45 minutos de debate. A solas apuntaron como gesto positivo el consenso alcanzado con la oposición.
Y celebraron haber conseguido tres medias sanciones de leyes que tendrán impacto sobre problemas cotidianos de la gente en las horas previas al anuncio presidencial de profundización del aislamiento en la región del AMBA. Ninguno de los dos lo expresó, pero la imagen fue tan distinta a lo ocurrido 24 horas antes en el Senado que hasta la oposición pagó costos internos. En esa charla a solas intercambiaron opiniones respecto a cómo ayudar a Axel Kicillof en el control de la circulación y el transporte.
El jueves pasado el mediodía, a 100 días de iniciado el aislamiento social y obligatorio, los jefes de todos los bloques acordaron en Diputados la vigencia del protocolo de funcionamiento remoto hasta esa sesión que arrancó el jueves a las 16:15 y terminó en la madrugada del viernes. Para algunos ya estaba vencido, pero hicieron la vista gorda y contabilizaron sólo los días hábiles para que dieran las cuentas en favor del avance de las leyes que regulan el teletrabajo y la nueva ley de economía del conocimiento. Los diputados están convencidos de que serán instrumentos que generen empleo e ingreso de divisas.
También se votó una ley para concientizar en los beneficios de la donación de plasma que redactó Máximo Kirchner y que por los buenos oficios de Cristian Ritondo y Carmen Polledo en Juntos por el Cambio logró unificarse con otras iniciativas. El radical Mario Negri reivindicó en ese sentido a la joven Josefina Mendoza, diputada y flamante mamá, que ya el 7 de mayo había propuesto la donación de plasma junto a otros legisladores del mismo partido.
Sin embargo, antes de la sesión hubo tensión. Se coló el eco del enojo de Juntos por el Cambio en el Senado donde el kirchnerismo avanzó sin consenso con la creación de una comisión Bicameral de investigación de los créditos que el Banco Nación otorgó en los últimos cuatro años a la empresa Vicentin. La idea no incluye la posibilidad de hurgar en los créditos que la gestión de Cristina Fernández dio a la misma agroexportadora, además de que otra vez se priorizó una iniciativa del ultrakirchnerista Oscar Parrilli.
“Ella construye poder y rompe puentes, es una manera de construir poder”, reflexionó un diputado del PRO que prefiere en el marco de la pandemia el diálogo y el consenso. Coincidieron con él quienes decidieron en Diputados dar la espalda a esa disputa y avanzar con su agenda. Los únicos que se salieron del libreto fueron Gabriela Cerruti, del Frente de Todos, y Fernando Iglesias, del PRO. Ella reclamó discutir todo tipo de iniciativas, lo que incluye Vicentin y el impuesto a la riqueza mientras que él quiso hacer uso de la palabra por afuera del acuerdo de los bloques y volvió a denunciar que el Congreso no funciona justo en una jornada donde más de 250 diputados estuvieron conectados durante casi diez horas. En comisiones hay casi 2000 proyectos ingresados en lo que va de la pandemia. Y casi siempre tienen no sólo asistencia perfecta sino que participan incluso diputados que no las integran pero aprovechan la posibilidad de la conexión remota para ser parte.

De inmediato el viernes fueron giradas al Senado las tres medias sanciones. No ocurrió lo mismo a la inversa: la cuestionada Bicameral investigadora no llegó a la Cámara de Diputados de la Nación. Massa sólo recibió la carta de los jefes de los bloques de la UCR y el PRO advirtiendo la invalidez del trámite parlamentario. Alegaron que requiere los dos tercios como si se tratara de una resolución de la Cámara. El Frente de Todos en cambio sostiene que se trata de un proyecto de ley que requiere solamente la simple mayoría y que se impulsó por ley, como la Bicameral que investigó el hundimiento del ARA San Juan. Además, desde el oficialismo hicieron circular la versión taquigráfica de la sesión del 17 de diciembre del 2014 en la que Gerardo Morales y Miguel Pichetto habían mantenido esta misma discusión respecto a una bicameral sobre el banco HSBC. Esta semana José Mayans, que entonces era vice del bloque del Frente para la Victoria, usó los mismos fundamentos que aquel día usó el flamante auditor y hombre de consulta de Mauricio Macri.
En Diputados no hay margen matemático ni político para reeditar esta batalla. Massa está obligado a dialogar con Negri, Ritondo y Maximiliano Ferraro de la Coalición Cívica y prefiere no perder tiempo en disputas palaciegas que no siempre comparte. Su discurso hacia el interior de su propia alianza será que en el actual contexto sólo se deben tratar temas “para la gente”. Es el argumento que en la madrugada le dio a Máximo Kirchner tras mostrarle algunos elogios en las redes sociales. Kirchner es el único de la familia que no tiene cuenta en Twitter, ni en Instagram, ni en Facebook. Y el propio hijo de la Vicepresidenta se mostró más empágico y conciliador que su madre.
El oficialismo en la Cámara baja tiene un condicionante. Con el protocolo vencido y la presión de algunos senadores de Juntos por el Cambio sobre el bloque de diputados, la negociación de los respectivos reglamentos para sesionar a distancia se daría en paralelo. El senador Esteban Bullrich, del PRO, pidió coordinar estrategias. Excepto para cuestiones que requieran dos tercios de los votos el kirchnerismo tiene quórum y mayoría en el Senado, por eso necesitan que los diputados presionen del otro lado del Palacio. Bullrich juega en tándem con Martín Lousteau que cada vez que puede se diferencia de Cristina Fernández. Los intercambios entre el porteño y la Vicepresidenta ya son un clásico en cada sesión.
En Diputados en cambio el Frente de Todos tiene 119 votos y Juntos por el Cambio 116. Es imprescindible el consenso entre ambas fuerzas mayoritarias o entre el FdT y los partidos más chicos que representan a fuerzas provinciales y gobernadores.

Tras el anuncio de este viernes en ambas cámaras anticiparon que adherirán a las restricciones por el COVID-19 y mantendrán guardias mínimas. Probablemente durante las próximas dos semanas no haya sesiones, aunque es intención de Massa tratar de convocar al menos a una y que las comisiones continúen funcionando. Al Senado le viene bien un descanso para calmar los agitados ánimos en el marco de una pelea que arrancó en el recinto y se expandió en los medios y en las redes sociales.
En uno de sus encuentros semanales el presidente Alberto Fernández le anticipó a Massa que enviará un proyecto de ley para que la ampliación presupuestaria no salga por DNU sino con el voto del Congreso. Sin Presupuesto 2020 y después de la polémica que generó el DNU 457 que facultó al jefe de Gabinete a disponer de partidas a discreción el jefe de Estado preferiría cambiar de instrumento.
Para Juntos por el Cambio la sesión del jueves 25 fue un cierre a 100 días del inicio del encierro. Creen que es hora de barajar y dar de nuevo. Hasta que el panorama no esté más claro, tanto en el oficialismo como en la oposición prefieren hacerse los distraídos con los fantasmas que los sobrevuelan. Ante la pregunta sobre la expropiación de Vicentin o el aporte extraordinario a las grandes fortunas responden que son proyectos que no han sido presentados y advierten que el sistema remoto no soportaría sesiones más largas que la de esta semana. Citan como ejemplo la caída del sistema el pasado jueves, aunque también es cierto que se reinició en un par de minutos y no hubo inconvenientes con las votaciones.
“En tiempos de pandemia hay temas que son fundamentales y temas que no”, señaló Cristian Ritondo jefe del bloque del PRO el viernes por la tarde. Mario Negri, jefe del interbloque de Juntos por el Cambio y de la UCR, se quedó en Córdoba pero desde allí siguió todas las negociaciones y conversó varias veces con Massa y con el resto de los jefes de bloques. Se muestra prudente y cauto frente a lo que viene.

Ritondo, por su parte, avisó: “Vamos a ir en contra de la expropiación de Vicentin o de cualquier empresa privada que esté en concurso”.
Y Álvaro González, vicepresidente de la Cámara y del círculo más cercano a Horacio Rodríguez Larreta, le dijo a Infobae que la discusión sobre la continuidad del protocolo depende de los plazos para el reinicio de las sesiones presenciales.
Para consensuar agenda y funcionamiento Massa citaría a una reunión de jefes de bloques por teleconferencia como un gesto al Ejecutivo que pidió a todos los poderes ayudar a bajar la circulación. En esa reunión virtual propondría, además del proyecto de ley de ampliación presupuestaria (el actual presupuesto es el de 2019 prorrogado) consensuar una moratoria para pymes; la suspensión de los desalojos de inquilinos y unificar varios proyectos que establecen beneficios impositivos y créditos a tasa cero para dos de los sectores más golpeados, el del turismo y la gastronomía. La ampliación presupuestaria se destinaría al pago del Ingreso Familiar Extraordinario (10.000 pesos para las familias sin ingresos en blanco); los ATP (pago de medio salario a trabajadores registrados); jubilaciones y también el paquete de obras para municipios con recaudaciones y coparticipación reducidas por lo menos en un 50 o 60 por ciento. Esta vez el Gobierno cambió de opinión e intentará votar una ley.
En la nueva etapa que comienza los partidos chicos quieren hacer oír su voz. Desde el bloque que tiene línea con Roberto Lavagna ya se mostraron a favor de investigar los créditos otorgados a Vicentin. Pero insistirán en que la Bicameral nació mal. “Así como la crearon esa comisión será muy cuestionada, se le siguen dando argumentos a la empresa”, sostuvo el lavagnista Alejandro ‘Topo’ Rodríguez, quien está dispuesto a presentar una iniciativa similar para que se vote en Diputados y se reinicie el trámite en el Senado como si las peleas no hubieran ocurrido y con votaciones que no dejen dudas sobre la legalidad ni la legitimidad del organismo a crear.
“Otra vez la grieta. De un lado los que se niegan a investigar el caso Vicentin cuando hay razones más que suficientes para aclarar la oscura relación con el Banco de la Nación (gobierno anterior). Del otro lado los que quieren forzar la investigación pasando por encima de procedimientos legales (gobierno actual)”, escribió Lavagna tras el tironeo.
En el kirchnerismo no presentan mucha atención al ex ministro de Economía, pero en el entorno del presidente Alberto Fernández sí. A veces oficia como mediador desde esa nueva avenida del medio y ayuda al Presidente a mostrarse más moderado. El Presidente sabe además que una parte de la sociedad empieza a perder la paciencia.
Para que no se paralice el Parlamento en Diputados deberían avanzar en la misma línea del diálogo mantenido hasta el momento aún cuando para las leyes de teletrabajo, economía del conocimiento y hasta con la inocua donación de plasma, hubo algunas disputas internas en los bloques y quien tuvo que ceder. “Son las leyes posibles, no las que queremos”, se oyó como argumento cuando las diferencias parecían insalvables. Algunos diputados de Juntos por el Cambio lo blanquearon en el recinto, como Karina Banfi, que de todos modos votó a favor. Lo mismo ocurrió cuando se presentó el nombre de Miguel Ángel Pichetto para ocupar el cargo vacante en la Auditoría General de la Nación. El Frente de Todos superó la incomodidad del momento y anunció su abstención. Cecilia Moreau asumió la voz del bloque y cuestionó al ex senador y ex candidato a vicepresidente de Mauricio Macri. Seguramente su discurso tuvo menos críticas que las que hubieran expresado los más cercanos a Cristina Kirchner.
“Nos rayaron un poquito el auto”, aceptó un importante dirigente de Juntos por el Cambio que tomó esas palabras como parte del juego de la política. Moreau dijo que expresó lo que sentía su bloque, aunque hizo mucho más que eso: se convirtió en el escudo protector del orgullo del kirchnerismo que esta vez silenció sus micrófonos.
