“Estos abusos no fueron solamente sexuales, sino también de poder y de conciencia, al violentar primero su condición de mujer y también lo más profundo de su vocación y fe bajo una obligada, pero desvirtuada, obediencia a su guía espiritual, según él, en el método del amor”, aseguró en su alegato Madrea, según precisó el Ministerio Público a través de su portal institucional fiscales.gob.ar.
De acuerdo al relato de las propias víctimas, mientras Pascual abusaba de ellas “las confesaba y las absolvía de sus pecados”. Otras religiosas declararon como testigos y contaron otros casos similares que también atribuyeron al cura, denuncias que prescribieron por el paso del tiempo, ya que habrían ocurrido a fines de la década del 80.
Pascual llegó al juicio excarcelado, acusado de los delitos de “abuso sexual gravemente ultrajante y con acceso carnal perpetrado de manera continuada entre los años 2012 y 2016″ y “abuso sexual gravemente ultrajante perpetrado de manera continuada entre los años 2014 a 2016″, contra las dos monjas. En los dos casos, consideró la acusación, se trata de abusos agravados por haber sido ejecutados por un ministro de un culto reconocido.
Los hechos que son juzgados ocurrieron en la sede de la comunidad de las Hermanas de San José, en Ernesto Bavio al 2800, donde funciona el Hogar Amparo Maternal a pocas cuadras del estadio de River, y en un lugar llamado “La Ermita”, donde se llevaban a cabo retiros espirituales.
Según la acusación –de la que también participó la Unidad Fiscal Especializada en Violencia contra las Mujeres (UFEM)–, el padre Pascual abusó sexualmente de las víctimas, aprovechándose de la situación de vulnerabilidad que tenían ambas y utilizando la autoridad –de todo tipo– que ejercía, lo que les impedía a las mujeres rebelarse y consentir libremente.
En ese sentido, Madrea detalló que las víctimas “soportaron las intromisiones sexuales a lo largo del tiempo, aún en medio de la ‘confesión’ sacramental e incluso durante una celebración o un rezo”.
“Pascual se habría valido de su rol de confesor y guía espiritual para, primero, obtener su plena confianza, manipularlas después para ‘aceptar su amor como algo sagrado’ o forzar el contacto para no echarlas, y luego avanzar en las maniobras abusivas. En esa línea, las mujeres relataron que el sacerdote las ‘confesaba y las absolvía de sus pecados’ durante esas situaciones. Marcaron también que hablaba de ‘sanarlas’ de sus heridas, de practicar su sexualidad para conocerse y las convencía de que debían ‘dejarse querer’ por él”, sostuvo Madrea en su alegato.
Al momento de solicitar la pena, el fiscal manifestó que los hechos fueron sumamente graves no solo por la escala penal y la naturaleza de todo abuso sino por sus características tan traumáticas y disruptivas, al haber sido cometidos en un ámbito religioso donde voluntariamente se profesa una vocación religiosa, donde ciertos valores como la castidad son intrínsecos también desde la mirada de quien pretende esa vida.
