Y la oposición denunció que busca “robarse un lugar en el Consejo de la Magistratura”
Por decisión de Cristina Kirchner, el espacio ofcialista se fragmentó en dos: por un lado quedó “Unidad Ciudadana”, espacio referenciado en la vicepresidenta, y del otro el “Frente Nacional y Popular”, alineado con los gobernadores. La reacción de Juntos por el Cambio.
Cristina Kirchner intenta una jugada política para sumar un representante en el Consejo de la MagistraturaPor impulso de Cristina Kirchner, el bloque del Frente de Todos partió en dos la bancada en el Senado con el objetivo de poder ocupar una banca más en el Consejo de la Magistratura, en medio de una batalla política para evitar el control de la Corte Suprema del organismo que designa y remueve a los jueces.
La polémica decisión, que fue recibida con duras críticas y acusaciones por la oposición, implica que el bloque original del Frente de Todos quede conformado por “Unidad Ciudadana”, espacio referenciado en la vicepresidenta, y el “Frente Nacional y Popular”, alineado con los gobernadores.
El presidente del interbloque de Juntos por el Cambio, el senador Alfredo Cornejo, no dudó en describir la situación como una jugada “para robarse un lugar en el Consejo de la Magistratura”.
El movimiento en el oficialismo se conoció a última hora de la noche de este martes. Mediante dos cartas dirigidas a la titular de la Cámara Alta se confirmó la conformación de ambos espacios. Presidido por Juliana Di Tullio, legisladora que responde políticamente a CFK, “Unidad Ciudadana” contará con Carlos Linares, Mariano Recalde, Guillermo Snopek, Anabel Fernández Sagasti, Oscar Parrilli, Silvia Sapag, Claudio Doñate, Silvina García Larraburu, Nora del Valle Giménez, Ana Ianni, Matías Rodríguez, María Eugenia Dure, y Sergio Leavy.
De los 35 senadores que tenía el bloque del Frente de Todos, 21 formarán el Frente Nacional y Popular con José Mayans a la cabeza. Acompañando al dirigente formoseño estarán: Guillermo Andrada, Daniel Bensusán, María Eugenia Catalfamo, Maurice Closs, Lucía Corpacci, Carlos Espínola, María Teresa González, Ricardo Guerra, Edgardo Kueider, Claudia Ledesma Abdala, Marcelo Lewandowski, Cristina López Valverde, Sandra Mendoza, Gerardo Montenegro, José Neder, María Pilatti Vergara, Antonio Rodas, Adolfo Rodríguez Saa, José Uñac y Pablo Yedlin.
La división del bloque oficialista sucede en medio de la feroz interna del Frente de Todos, pero también en un momento de resistencia del kirchnerismo a ceder el control del Consejo de la Magistratura a la Corte Suprema de Justicia de la Nación. Por ello, la jugada estaría relacionada con los nombramientos en el organismo que designa y remueve jueces. El fundamento que avala esta hipótesis es que, de esta forma, el ex bloque del FdT podría llegar a tener dos miembros -uno por la mayoría y otro por ser la segunda minoría-, mientras que si se mantenía con la conformación anterior accedía a un solo miembro y el otro le correspondía a Juntos por el Cambio.
“Vergonzosa e impostada división del Bloque de senadores del Frente de Todos para intentar robarse un lugar en el Consejo de la Magistratura”, denunció Cornejo.
En las últimas horas, Juntos por el Cambio había amenazado con denunciar penalmente tanto a Cristina Kirchner como al presidente de la Cámara de Diputados, Sergio Massa, si no avanzaban con la designación de los dos representantes que faltan para el Consejo de la Magistratura.
En la Cámara Baja, el titular del bloque del oficialismo, Germán Martínez, presentó este martes una nota formal a Massa para que se abstenga de firmar el nombramiento de Roxana Reyes, la candidata propuesta por la UCR, hasta que no se defina con claridad cuál es el criterio para determinar qué fuerza es la segunda minoría de la Cámara.
El lunes la Corte Suprema asumió la conducción del Consejo de la Magistratura, tras haber declarado la inconstitucionalidad de la ley de 2006. El Máximo Tribunal argumentó que la conformación del organismo no respetaba el equilibrio entre los diferentes estamentos políticos y técnicos. En el mismo fallo, le fijó un plazo de 120 al Congreso para que sancione una nueva normativa. Si bien un proyecto del kirchnerismo obtuvo media sanción en el Senado, luego naufragó en la Cámara baja. Finalmente, el plazo venció el viernes pasado.
El mandato de la Corte señalaba que si no se sancionaba una nueva ley, el Consejo volvería a su conformación original de 20 integrantes, tal como estipulaba la norma de 1997. Esa norma asignaba cuatro legisladores consejeros por cada una de las Cámaras y actualmente sólo hay tres. Por eso la UCR y el PRO presionan para que sus representantes -la diputada Roxana Reyes y el senador Luis Juez- sean nombrados.
Tras la ruptura del bloque del Frente de Todos en el Senado, molesto con la jugada de CFK, Juez manifestó que “los delincuentes aprovechan la nocturnidad”. “Esto desnuda y pone en evidencia el pánico que le tiene Cristina a la Justicia”, señaló. “Esto claramente es una maniobra para quedarse con la banca que le correspondería a la oposición”, agregó en declaraciones a la prensa.
“Es una maniobra ridícula, torpe y absurda para quedarse con una banca en el Consejo de la Magistratura” que le permita a Cristina Kirchner “seguir apretando jueces o nombrando punteros políticos”, enfatizó Juez.
Este lunes, en medio del desembarco de la Corte en el Consejo, el viceministro de Justicia de la Nación, Juan Martín Mena, acusó a los jueces del Máximo Tribunal de ser responsables de “un deterioro democrático y jurídico” y que su accionar “es causal de juicio político” al considerar que la Corte cometió “mal desempeño”.
“Nosotros vamos a seguir trabajando en una profunda reforma al sistema de justicia”, advirtió Mena remarcando que el Kirchnerismo “no puede permitir que la Corte legisle cercenando las facultades del Poder Legislativo”.
