El Gobierno podría nombrar más de 600 jueces y fiscales
Reforma judicial: El proyecto de reforma judicial que impulsa el Gobierno implica la duplicación de cargos. Con los cambios que se implementaron en la propuesta la semana pasada en plenario de comisiones del Senado se determinó que creará 316 nuevos puestos. Sumados a los nombramientos que todavía no se realizaron llega a más de 600 en total, una cantidad similar a la cantidad de cargos que hay actualmente en la Justicia. Tendría un costo de $3.600 millones.
Entre las modificaciones al proyecto, que obtuvo dictamen, están la creación de cinco Cámaras de Apelaciones en el interior. Se trata de tribunales de alzada en Tierra del Fuego, Santa Cruz, Neuquén, San Juan, Catamarca, La Rioja, Jujuy, Formosa, Santiago del Estero, La Pampa y San Luis. Responde a un reclamo de gobernadores de provincias en los que estos tribunales están en otras jurisdicciones.
La iniciativa dispone la creación de 316 nuevos cargos de jueces, fiscales y defensores en la justicia federal. Se suman a los 134 concursos de jueces en trámite en el Consejo de la Magistratura, los 153 pliegos enviados por el Gobierno y 70 vacantes. Son más de 600 puestos, una cifra en línea con la cantidad de cargos que hay en la Justicia.
La senadora de Juntos por el Cambio Silvia Giacoppo recordó que el oficialismo comunicó que de sancionarse la ley implicará un costo de casi $2000 millones, aunque advirtió que el monto sería mucho mayor. “Es todo tan empírico que el oficialismo primero hablaba de 1.939 millones más y ahora habla de 3.600 millones pero nadie sabe a ciencia cierta la cifra real”, afirmó en diálogo con Clarín.
La cobertura de los 316 nuevos puestos con titulares llevaría al menos dos años, entre concursos y acuerdos con la oposición. Giacoppo explicó: “Tendremos subrogantes que no son subrogantes y esto será de una nulidad plena y absoluta porque será como una corte especial armada violando todos los tratados internacionales del debido proceso, de la designación de jueces y del juez natural”.
La senadora de Juntos por el Cambio Laura Rodríguez Machado advirtió que la creación de cargos “reforzarán el feudalismo judicial en algunas provincias, como Formosa, donde el gobernador Gildo Insfrán ya controla la justicia provincial y ahora tendrá una parte de la federal”. La legisladora sospecha que el kirchnerismo consiguió votos en la Cámara alta, además, por el festival de obras públicas para las provincias”.
Pese a que los cargos para jueces, fiscales y defensores se concursarán en el Consejo de la Magistratura o el Ministerio Público Fiscal, el diputado de Juntos por el Cambio Pablo Tonelli criticó que las 319 vacantes de secretarios, oficiales, auxiliares y maestranzas “buscarán que sean para familiares y amigos de los gobernadores y senadores”.
El integrante del Consejo de la Magistratura Juan Pablo Más Vélez cuestionó que no hubo consultas a la subcomisión del Mapa Judicial sobre las estadísticas de juicios en cada provincia para determinar donde debían crearse nuevos juzgados federales. En esta línea, el presidente de la Asociación de Magistrados y Funcionarios del Poder Judicial (AMFJN) Marcelo Gallo Tagle cuestionó que presentó en el Congreso una gran cantidad de pedidos para crear tribunales a partir de estadísticas, pero que no se los aceptaron.
