En Tucumán las cárceles están colapsadas
La situación se agravaría aún más hasta fin de año.
Luego de las fugas que se produjeron en dos comisarías y el intento de motín en otra dependencia policial, quedó al descubierto el grave escenario que atraviesa el sistema penitenciario de la provincia.
Por la crisis carcelaria, no hay lugar para alojar a los presos y las capacidades están superadas en un 300% en las comisarías y un 30% en los penales.
Pero esta situación, lejos de encontrar una solución podría agravarse en el transcurso de los próximos meses, porque se estima que hasta fin de año deberían ingresar al sistema otras 1.300 personas como mínimo. Actualmente hay 1.300 detenidos en las comisarías, más del triple de lo permitido, y cumplen sus condenas 1.350 presos en los penales de Tucumán.
La implementación del nuevo código procesal penal de la provincia significó un cambio en el sistema judicial e incrementó el dictado de prisiones preventiva, por lo que muchos acusados terminan alojados en los calabozos de las comisarías.
Al respecto de esta situación, el secretario de Seguridad, Luis Ibañez declaró, “Se ha formado un cuello de botella y de seguro habrá más detenidos. Por eso estamos trabajando con prisa para preparar nuevas estructuras que sirvan para alojar más detenidos”.
Según las estadísticas que maneja el Poder Judicial, en mayo fueron 220 personas las que terminaron tras las rejas. De ese número, a unas 170 se les dictó la prisión preventiva; las 40 restantes fueron condenadas por el régimen conclusional y a otras 10 con el nuevo código. A este ritmo, hasta fin de año los calabozos de la provincia tendrían que alojar a unas 1.300 personas más.
Esto lleva a concluir que el sistema carcelario de la provincia está colapsado. Actualmente hay 2.600 detenidos y de incoporarse 1300 presos más hasta fines de año, la superpoblación carcelaria se incrementaría en un 50%. Estos números sólo corresponden al Centro Judicial Capital, dejando de lado los procesados de los tribunales de Concepción y de Monteros, que podrían aportar entre un 20 y un 30% más de presos.
Según datos obtenidos de un informe reservado, en todas las dependencias policiales hay hacinamiento de detenidos. En la mayoría de las seccionales hay más del número permitido y en algunas dependencias hay el doble de detenidos de lo que permite su capacidad.
“Esta es la consecuencia de no haber tomado los recaudos necesarios. Se advirtió que con el nuevo digesto se resolverían las causas de manera más rápida, pero evidentemente no nos escucharon”, indicó una fuente del Colegio de Jueces. Los magistrados advirtieron que no dejarán de aplicar la ley por esta situación. “Los delitos se incrementan al igual que su gravedad. Lo vemos todos los días”, agregaron.
El jefe de Policía Manuel Bernachi reunió el martes a la plana mayor de la fuerza para explicarle las gestiones que se están haciendo para descomprimir la situación en las dependencias. También les pidió que se hicieran mayores controles para evitar nuevas fugas de detenidos.
En tanto que los legisladores republicanos Ricardo Bussi y Horacio Vermal presentaron un pedido para que el ministro Claudio Maley informe cuál es la capacidad de alojamiento de personas detenidas y cuál es la cantidad de reos que se encuentran en las comisarías, cuántos son los condenados que no han pasado al penal y cuánto es el tiempo de demora para que se concreten los traslados.
