Juró como miembro de la Corte de Santa Cruz un amigo de Máximo Kirchner que nunca ejerció la abogacía
Fernando Basanta, el segundo de la izquierda, tras asumir el viernes pasado como integrante del Superior Tribunal de Justicia.
Fernando Basanta, abogado y ex funcionario del gobierno de Alicia Kirchner, juró como nuevo integrante del Superior Tribunal de Justicia de Santa Cruz, nombramiento que se vio envuelto en una fuerte polémica y en un nuevo escándalo judicial en la provincia.
La asunción de Basanta, además íntimo amigo de Máximo Kirchner y militante de La Cámpora se produjo el último viernes, con escasa difusión por parte del órgano de justicia santacruceño.
La presidenta del tribunal superior, Paula Ludueña, fue la encargada de tomarle juramento con la presencia de los otros integrantes de la corte, Daniel Mariani, Alicia Mercau y René Fernández.
También estuvieron presentes numerosos funcionarios del gobierno y dirigentes del kirchnerismo. Basanta reemplaza a Enrique Peretti, quien se jubiló en abril de este año.
La llegada del abogado, quien además fue aportante en la campaña de Alicia Kirchner para la gobernación de 2015, se produjo en el marco de una nueva maniobra K para contar con una corte adicta.
Sin los requisitos
Su nombramiento, que contó con el voto de la mayoría en la Legislatura provincial, fue calificado como ilegal por gran parte del arco político opositor.
Es que Basanta no reúne las condiciones mínimas que exige la Constitución Provincial para ejercer ese cargo.El reconocido constitucionalista Daniel Sabsay calificó la llegada de Basanta al máximo tribunal como “una violación clara a la forma republicana de gobierno” y dijo que “resulta a las claras algo escandaloso que pisotea la carta magna”.
Basanta es un abogado de 42 años.

La Constitución Provincial expresa en su artículo 127 que “quienes pretendan integrar el Superior Tribunal de Justicia deben contar con el ejercicio de la profesión de abogado al menos por 6 años».
Basanta no los tenía porque además nunca se matriculó en la provincia.
Pero contar con la mayoría absoluta en la legislatura le permite al gobierno de Alicia contar con algunas “licencias”, incluso más allá de la Constitución.Por eso, el Frente de Todos hizo una “interpretación amplia” del artículo 127 y tomó en cuenta el tiempo que el ahora juez de la Corte estuvo en la administración pública.
Además de aportar para la campaña, Basanta fue nombrado en 2015 ministro de gobierno de Alicia, cargo en el que se desempeñó hasta 2019 para luego ser nombrado fiscal de instrucción de Río Gallegos.

Nunca trabajó en la actividad privada ni se matriculó.
Pero para su nombramiento fue tomado en cuenta un antecedente fundamental para el kirchnerismo: es amigo de Máximo, el hijo de la vicepresidenta.
Críticas opositoras
La oposición criticó duramente el nombramiento.
Previsible: mientras en Buenos Aires, la vice y sus seguidores denuncian un supuesto complot judicial en su contra, en Santa Cruz las conexiones entre la familia y los funcionarios de la Justicia es viejo y conocido. Incluye familiares. La oposición provincial denunció que “se pisoteó la Constitución” y calificó de “ilegal” la llegada de Basanta al máximo tribunal. Actualmente hay presentados dos recursos de amparo contra la designación, pero con la justicia volcada absolutamente al sector gobernante será muy difícil que prosperen.
La mayoría del FdT utilizó sus 16 votos para darle vía libre al nombramiento. Hubo cuatro votos en contra y tres abstenciones de los legisladores de la UCR, Encuentro Ciudadano y Somos Energía para Renovar Santa Cruz.
