Hago públicos los lamentables hechos vividos en la reunión de Consejo Superior del viernes 23.
Para poner el tema en contexto, aclaro que estamos en nuestra universidad en pleno proceso de recambio de autoridades. Se renuevan todos los cargos: Rector y vice, Decanos y Consejos Superiores.
Estábamos citados a reunión de Superior para tratar la composición de la Junta Electoral.
Si bien la sesión fue declarada secreta porque habia público y para evitar la tensión que la presencia de terceros generaba, hemos vivido sucesos de tal violencia, autoritarismo y arbitrariedad, que me veo obligada a expresar mi profundo desagrado con lo ocurrido y poner en conocimiento de la comunidad universitaria lo ocurrido.
Citados a las 12 horas, habian concurrido a la sesión dos consejeros titulares del Cuerpo que se hallaban en uso de licencia, acompañados de escribana publica porque tenian noticia de que no se les pernitiría asumir.
Efectivamente, el rector así lo manifestó y dispuso que la sesión se llevara adelante con los suplentes, alegando que la sesión era extraordinaria y no podia tratarse el tema de la inclusion de los titulares porque no estaba en el «orden del día», ante lo cual los consejeros titulares permanecieron en sus lugares pese a que se les ordenó retirarse.
Pedí el uso de la palabra para dar las razones juridicas por las cuales entendía que se debia incluir de inmediato a los titulares. Porque fueron elegidos como titulares por otro colegio electoral y no por el Consejo Superior, y porque sus títulos como integrantes del Cuerpo nunca fueron cuestionados. Porque vedarles la incorporacion por una cuestión administrativa (no estar en el orden del dia pese a que sus planteos habian sido presentados antes de la convocatoria a reunion extraordinaria pero el rector manifestaba que los escritos no habian llegado a su despacho) era impedirles el ejercicio de un derecho que se ha considerado que el titular puede retomar en cualquier momento con tan sólo apersonarse. Cité como ejemplo el Reglamento del Senado nacional y de la Legislatura provincial que disponen eso para las licencias de Senadores y Legisladores.
Mientras hablaba, la Decana de la Facultad de Filosofia y Letras Mercedes Leal me interrumpía, el rector también, y otros consejeros que acompañan su candidatura a vicerrectora hacían lo mismo. Pagani-Leal conforman la fórmula que apoya el Rector. En la sesión estaban los candidatos a Rector y Vice, Pio Jimenez y Hugo Fernandez, y también Decanos y consejeros superiores que adherimos a la misma, como Rosa Castaldo, Ruben Taboada, Roberto Corbella y yo, entre otros.
Leal le pedia al rector que me callara, gritando que no me queria escuchar, dando muestras de su proverbial autoritarismo. Le dije que como candidata a vicerrectora no debía promover eso. De hecho, su actitud y la asumida por el rector desde el primer momento fueron los hechos que impidieron el transcurso razonable de la sesión. Tuve que ponerme de pie y levantar la voz para concluir mi intervención. Posteriormente pedí disculpas al Cuerpo por haber levantado la voz y expliqué lo que la consejera Leal gritaba ya que quizas al fondo del salón no se entendía.
El rector echó a la escribana y Leal levantaba el tono de su agresión en mi contra mientras trataba de explicar que no podiamos impedir el uso de la fe publica que los consejeros habian solicitado al pedir la intervención de una escribana. El rector insistió echandola inalmente de la reunión.
Luego, todo lo que ocurrió fue bochornoso. Los integrantes del Consejo Superior que acompañamos a la fórmula opositora recibimos un trato injuriante y de una violencia verbal intolerable, y fuimos victimas de los peores insultos que se usan en tiempos de grieta política en este país.
Hoy he expresado mi desagrado por lo ocurrido en el grupo de Decanos. Copio el texto más abajo.
Allí aludo a cuestiones que quizas no entenderán. Pero les anticipo que les voy a explicar en unos días. Me refiero a los hechos del ejecutivo universitario de entrega de los derechos de la Universidad a los intereses de las corporaciones mineras más importantes del mundo a un precio vil. Se ha puesto toda la infraestructura de Ymad al servicio de una grandiosa explotación minera sin que haya aún informe de impacto ambiental y por monedas, a espaldas del Consejo Superior y de toda la comunidad universitaria.
Ahora va el texto que compartí en el grupo de Decanos:
«Buenos dias colegas: los hechos vividos en la última reunión de Consejo Superior han sido lamentables por su violencia extrema. Todos nos conocemos, sabemos de los rasgos personales de cada uno. Creo que mi apasionamiento para defender mis interpretaciones juridicas es una marca personal. He defendido el derecho de los consejeros titulares de reintegrarse a sus escaños y dar por concluidas sus licencias cuando desean hacerlo. Porque esto es un principio del Derecho parlamentario. Mientras lo hacía, Mercedes me gritaba con desprecio que no me quería escuchar. Porque el propósito era nombrar las autoridades de la Junta Electoral con los votos de los suplentes.
El tiempo me dará la razon. Pero no ocurrirá dentro de dos años, probablemente la semana próxima el grupo que acompaña la candidatura de Sergio y Mercedes avalará el remplazo de algún consejero suplente por su titular para integrar alguna mayoría. Ahhh, pero será puesto en el orden del dia, como si el orden del dia otorgara el derecho y no la ley.
Porque lo que está ocurriendo es deplorable. Es el gobierno de la universidad por el que maneja el orden del día. La picardia que permitió que se firmen los acuerdos entre Agua Rica e Ymad.
No se puso el tema en el orden del dia aunque existía. El rector lo conocia y el Director de Asuntos juridicos. Y muchos otros funcionarios. Pero como no se puso en el orden del día, el Consejo Superior no pudo decidir sobre el patrimonio de la Universidad. La tirania del orden del dia…
Y el viernes, como la nota de pedido de reincorporacion de los consejeros no llegó supuestamente al rector, aunque fue presentada antes que se llamara a sesión, de nuevo el orden del día impedía la correcta integracion del cuerpo y ese era el derecho y no el derecho de haber sido elegidos como consejeros titulares.
Y la defensa de mi opinión jurididica me hizo recibir el insulto de que no se me quería escuchar….
Y despues los agravios más groseros que se pueden recibir en democracia. Porque el grito de gorilas y cipayos todos sabemos que esconde otra cosa en nuestro pais. Esconde vendepatria, esconde antiderechos, esconde fascista.
Valoro tu pedido de disculpas, Estela. Y denosto la soberbia y la violencia de Mercedes que no es la primera vez que se dirige a mí con su tono de superioridad moral por su supuesta pertenencia politica al bien y la mía al mal.
Niego categoricamente eso.
He defendido desde el primer dia la legalidad y los intereses de la universidad a rajatabla sin una sola concesión, sin un sólo coqueteo con posiciones intermedias de composicion de intereses como sí lo hizo Mercedes siempre. Hay derechos que no se negocian, que no pueden ser objeto de renuncias totales ni parciales…
Estuve siempre del lado de la Universidad publica y no firmé ningun convenio de ajuste con la SPU por ejemplo, y sostuve la necesidad de revisar la renuncia de nuestros derechos en ymad y defendí el patrimonio universitario con vehemencia mientras Mercedes tampoco me queria escuchar diciendo que a la ciudad universitaria habia que darla por terminada alguna vez …. y mientras Sergio se escondia y no participaba de las sesiones. Mandaba su vice. Porque su rasgo personal es no jugarse. Y ellos son el Bien de la universidad y yo y mis compañeros hoy somos el Mal y la derecha fascista y reaccionaria merecedora de agravios y desprecio.
Estoy a dias de dejar el 29 mi cargo de Decana, la función más honrosa de mi vida. Me voy con orgullo de lo que he vivido y logrado en mi Facultad. No puedo decir lo mismo de lo que he visto y vivido en el Rectorado de la Universidad. Tampoco de lo que hemos vivido yo y mis compañeros en la sesion del viernes.
Me voy violentada y dolida al ver el nivel de violencia para defender una interpretacion arbitraria, forzada y tendenciosa de la ley.
No voy a aceptar que se nos imponga secreto para el insulto o la degradacion. Voy a hacer público lo sucedido si lo considero necesario porque el secreto no es para tapar la violencia ni el apartamiento de la legalidad. No es para ponernos un bozal ni gritarnos improperios.
Lamento el silencio de los compañeros de bien que no fueron capaces de levantar la voz ante estos hechos.
Me despido y me retiro del grupo. Dejo de ser Decana el 30 de abril para asumir el cargo de Directora de la Escuela Judicial del Cam, obtenido por concurso y con la máxima calificación. Ya he renunciado a mi cargo de Decana y podria estar desentendida de lo que hoy ocurre en la Universidad. Pero me duele la Universidad.
Escribo estas palabras con dolor, porque creo de verdad en los intereses que defendi, me apeno de que nos hayamos dejado doblegar por un rectorado funcional a intereses de las mineras y seguiré defendiendo a la Universidad desde cualquier lugar, como la universitaria que soy, gane quien gane esta contienda electoral. Porque la entrega de los bienes de Ymad a Agua Rica sella la suerte de miles de jovenes en el futuro y el destino y la posibilidad de progreso de una provincia entera. Y porque no dormiría tranquila si no lo hiciera.
