La lucha por el Río Atuel: “Seguimos reclamando por el agua que nos quitaron”
La Comisión Interprovincial del Atuel Inferior solicitó a Ziliotto que pida una Audiencia con la provincia de Mendoza ante la Corte Suprema de Justicia de la Nación (CSJN). La Pampa reclama, desde hace décadas, que se haga justicia y se reparen los perjuicios ambientales, económicos y sociales sufridos, debido a las actitudes arbitrarias de la provincia de Mendoza con las aguas del Río Atuel.
La provincia ha reclamado históricamente por las vías legales correspondientes, y aseguran haber agotado todos los canales de diálogo y las posibilidades de consenso, pero nunca ha obtenido resultados favorables. A su vez, señalan que el distrito cuyano nunca ha cumplido con ninguna resolución, con ningún compromiso, ni ninguna legislación.
Entre otros incumplimientos, mencionaron la resolución n° 50/49 del Poder Ejecutivo Nacional, así como lo establecido por el Acuerdo firmado en 2008 entre los gobernadores. Desde la provincia del centro del país también denunciaron que Mendoza tampoco cumplió con lo dictaminado por el Tribunal Latinoamericano del Agua en 2016, ni con lo dictaminado por la Corte Suprema de Justicia en 2017.
Ya pasaron más de cuatro años desde que se tuvo por acreditado el daño ambiental, situación que se agrava día a día, porque no llega el agua del Atuel a territorio pampeano. Por todo esto, las y los miembros de la Comisión Interprovincial del Atuel Inferior (CIAI), tomaron la decisión de pedirle al Gobernador Sergio Ziliotto que solicite una Audiencia entre las partes ante la Corte Suprema de Justicia de la Nación (CSJN), con el objetivo de materializar lo que este tribunal resolvió ya en julio de 2020.
Las principales disposiciones emitidas en aquel fallo incluyen la garantización de un caudal mínimo permanente del río Atuel de 3,2 m3/s en el límite interprovincial entre La Pampa y Mendoza. Además, se ordenó fortalecer el organismo de cuenca y conformar la Comisión Interjurisdiccional del Río Atuel (CIRA).
“Hoy, 8 de agosto, Día de la Lucha por el Río Atuel, con un río menos que nos falta y con un desierto que nos sobra y que nunca quisimos, seguimos reclamando por el agua que nos quitaron”, expresaron desde la CIAI. En esa línea, concluyeron: “Es conocida nuestra histórica lucha, es innegable nuestro derecho a lo reclamado, es imprescindible un acto de justicia que repare el daño sufrido”.
