La ONU pidió a la Argentina que asegure la independencia del Poder Judicial
El Consejo de Derechos Humanos de la Organización de las Naciones Unidas le recomendó a la Argentina que asegure “la plena independencia del Poder Judicial”, días después que el Gobierno pidiera el juicio político contra la Corte Suprema de Justicia.
“Los Estados recomendaron que la Argentina asegure la plena independencia del Poder Judicial y de los fiscales, mejore las condiciones en las prisiones, garantice la legalidad en el uso de la fuerza e investigue su uso excesivo por parte de las fuerzas policiales”, fue la solicitud explícita del consejo, que fue compartida a través de un tuit.
El mensaje se dio luego que el secretario de Derechos Humanos, Horacio Pietragalla Corti, denunciara el “lawfare” y la presunta pérdida de legitimidad del Poder Judicial en Argentina, en el marco de la cuarta edición del Examen Periódico Universal (EPU) que se desarrolló en Ginebra.

El texto que difundió Pietragalla, en línea con el discurso del kirchnerismo duro, mencionó la presencia en el país de “discursos del odio” que “culminaron con el intento de magnicidio de la actual Vicepresidenta de la Nación, y dos veces Presidenta, Cristina Fernández de Kirchner”. “Estos postulados se advierten de modo creciente en diversos espacios políticos, en medios masivos de comunicación y en redes sociales. Se trata de una problemática compleja que constituye una preocupación a nivel internacional”, describió el funcionario.
Pietragalla también criticó a la Justicia argentina al referirse al lawfare: “Desde el actual Gobierno Nacional y el movimiento de derechos humanos se advierte que la práctica del lawfare –impulsada por sectores del Poder Judicial, la oposición política y sectores concentrados del poder económico y mediático– constituye una práctica violatoria de los derechos humanos y opera como condicionante de los procesos electorales, de la agenda política y de la opinión pública”.
“En estas causas judiciales, como las que enfrenta la ex Presidenta de la Nación, bajo la excusa de la investigación y sanción de hechos de corrupción, se violan garantías fundamentales del Estado de Derecho: se desconocen garantías básicas del debido proceso como la presunción de inocencia, el derecho de defensa y el principio de objetividad que debe guiar la actuación del Ministerio Público Fiscal. Estas causas penales se impulsan únicamente en contra de referentes políticos que representan a sectores populares, mientras se mantiene en la impunidad a sectores poderosos, que han permitido o avalado el endeudamiento criminal que ha generado pobreza e indigencia en la población”, añadió.
También, el funcionario aludió a una supuesta proscripción política contra el kirchnerismo en este año electoral. “La persecución política en sede judicial se encuentra plenamente vigente, en tanto integrantes del Poder Judicial y del Ministerio Público Fiscal siguen llevando adelante procesos penales fraudulentos contra las principales figuras políticas del actual oficialismo, otrora oposición al gobierno de la anterior gestión”, relató.
Y agregó: “Las estrategias de persecución, cuya finalidad última es la proscripción de figuras centrales del escenario político, son ejecutadas en la práctica por jueces y fiscales que visitaban asiduamente al ex presidente, tanto en su residencia oficial como en sus residencias privadas, lo que demuestra la espuria convivencia entre ambos sectores y la continuidad de una política de hostigamiento que afecta los principios democráticos de nuestro país, en especial aquellos que hacen a la independencia e imparcialidad con la que deben actuar el Poder Judicial de la Nación y los Ministerios Públicos”.
