Reforma judicial
El kirchnerismo no consultó con el Presidente la cláusula sobre los medios.
Ni Alberto Fernández ni la ministra de Justicia, Marcela Losardo, tuvieron espacio para discutir con los senadores del Frente de Todos la inclusión de la controvertida cláusulaque obliga a los jueces a reportar supuestas presiones «de los poderes mediáticos» en la reforma judicial . Ni esa, ni otras modificaciones que los legisladores kirchneristas le hicieron al proyecto del Presidente fueron consultadas al Poder Ejecutivo, sino apenas notificadas.
«Los cambios corrieron por cuenta de los senadores», se limitó a decir un importante funcionario. Muchos integrantes del gabinete y colaboradores estrechos de Fernández, de hecho, se enteraron de la cláusula contra los medios – que fue introducida por el cristinista Oscar Parrilli- una vez que el hecho estuvo consumado y el cambio estuvo plasmado en el dictamen.
En la Casa Rosada asimilaron el episodio con distintas reacciones. «Es una locura», dijeron en un despacho oficial. Otro importante ladero de Fernández se lamentó: «Es algo absurdo, que además parece impracticable ¿para qué lo hicieron?». No querían ver en la decisión de los senadores oficialistas un intento «conspirativo» contra el proyecto presidencial, pero aceptaban que la «cláusula Parrilli» aleja cada vez más las pretensiones del Presidente de que el proyecto se apruebe con amplio consenso.
«Insistimos, el proyecto todavía se tiene que debatir en el plenario del Senado y en la cámara de Diputados. Lo que quiere Alberto es que salga y que sea producto de una discusión y con aportes. También es cierto que la oposición rechazó el proyecto antes de leerlo», agregó un asesor presidencial.
Otro importante ministro, en cambio, intentó justificar la imprevista cláusula que que obliga a los jueces a denunciar ante el Consejo de la Magistratura presiones «de los poderes mediáticos». «No es como lo quieren mostrar la oposición y los medios. No es para condicionar o denunciar al periodismo, es para preservar la independencia de los jueces. Se hizo un estiramiento de algo que es inocuo. No sé si es oportuno o no, pero no es sustancial ni es como lo quieren presentar», dijo el alto funcionario sin mostrar fisuras con el kirchnerismo.
Ayer, Losardo estuvo en Olivos hasta entrada la noche. La ministra se puso en contacto con la senadora María de los Ángeles Sacnun muy brevemente y sólo para consultarle acerca de algunos juzgados del interior. Pero no conversaron sobre la cláusula de los medios, ni de otras modificaciones relevantes que corrieron por cuenta de los senadores.
También en el kirchnerismo presentaron a los cambios como una iniciativa con sello propio. «El proyecto pasó al senado y los senadores hicieron sus propias modificaciones», se limitó a decir un portavoz del kirchnerismo, como si el bloque de senadores oficialistas y la Casa Rosada fueran dos compartimentos desconectados.
De hecho, en el kirchnerismo duro hoy lanzaban dardos filosos contra Losardo. «La ministra no defendió el proyecto. Apareció en los primeros días y después no le puso el cuerpo públicamente», dijeron desde el Instituto Patria. Criticar a Losardo no es inocente, porque es una funcionaria 100% de Fernández. Es su amiga, su histórica socia jurídica y es por la confianza que tiene con el Presidente que hoy ocupa el cargo.
Hoy, cuando crecía la controversia por la cláusula contra los medios, el Gobierno anunció la salida del secretario de Energía, Sergio Lanziani, y el desembarco de Darío Martínez, un viejo rival político de Parrilli en el PJ neuquino.
Algunos en el Gobierno consideraban que el texto de la reforma podría volver a modificarse en el largo trámite legislativo que tiene por delante.»Por ahora es solo un dictamen», advirtieron. El debate podría aminorar su velocidad y sufrir nuevos cambios una vez que el proyecto pase a Diputados.
