Senado: dictamen favorable al proyecto que jerarquiza el Plan Nacional de Cardiopatías Congénitas
La Comisión de Salud dio visto bueno a la iniciativa que ya cuenta con media sanción de Diputados. Además, en reunión plenaria con la comisión Trabajo, se dio el puntapié inicial para debatir el proyecto sobre derechos laborales en las residencias.
La Comisión de Salud de la Cámara alta, presidida por el legislador del Frente de Todos Pablo Yedlin, firmó el dictamen del proyecto de ley, venido en revisión de la Cámara de Diputados, que avanza con el Plan Nacional de Cardiopatías Congénitas.
Este proyecto propone jerarquizar con fuerza de ley, y ampliar este plan nacional que fue creado en el 2008, y desde el 2010 funciona en el Hospital Garraham, y busca la detección temprana de estas cardiopatías que afectan a alrededor de 7.000 niños, niñas y bebés. Estas afecciones se detectan generalmente cuando los niños muy pequeños, o en el estado de embarazo, y por eso también se contemplan los estudios dentro del Programa Médico Obligatorio entre las semanas 18 y 22, para poder realizar una evaluación cardíaca fetal, y en el caso de que se detecte una anomalía poder proseguir con los estudios correspondientes, y que todas las personas tengan la cobertura necesaria para poder detectar estas condiciones.
Al respecto, Yedlin explicó que lo que se intenta es tratar de dar garantía por ley a que el plan que continúe, y establece una red de complejidad creciente en la Argentina para este tema. También, la sanción establece la obligatoriedad en las obras sociales y las prepagas, a través de la incorporación en el Programa Médico Obligatorio, de la detección y diagnóstico temprano de esta enfermedad.
Por otra parte, en reunión plenaria entre las Comisiones de Salud, y de Trabajo y Previsión Social, se dio inicio al debate sobre el proyecto de ley de la senadora Silvia Sapag sobre los derechos laborales en las residencias del equipo de salud.
La iniciativa apunta a modificar el artículo 2 de la Ley del Sistema Nacional de Residencias de 1979 para asemejarla a la Ley de Contrato de Trabajo, con el objetivo de permitir a los residentes a que puedan tener los beneficios de cualquier trabajador que se encuentre dentro del marco de la ley.
Sobre el mismo, la autora Silvia Sapag indicó que este proyecto de ley “viene a traer el resguardo de los residentes, y viene a poner límite a los abusos de las clínicas sobre los residentes, con la excusa de que ellos les proveen de una capacitación, que de ninguna otra forma no la podrían obtener”.
“En general nosotros vemos que, con las distintas modificaciones de la ley vigente, los residentes han tenido reconocimientos. Tienen casi todos los derechos de un trabajador, pero lo que está faltando es que tengan, por ejemplo, un seguro de mala praxis, que tengan un lugar dónde denunciar los abusos, y lo que está faltando es que haya un tope a sus guardias. Además, está faltando un contrato a plazo fijo”.
A su turno, Pablo Yedlin consideró que se trata de “un proyecto muy interesante, con un tema de mucha actualidad y de mucha importancia. En realidad, los sistemas de salud son definitivamente recurso humano capacitado que atiende a la población enferma. El recurso humano es fundamental”.
“Los residentes estatales tienen una relación contractual laboral con el Estado, con todas las garantías que las relaciones laborales tienen. Pero la ley que rige las residencias a nivel nacional, que es una ley firmada por Videla, es absolutamente antigua, y establece en su articulado que la relación contractual nacional con los residentes es de beca de formación. Y eso ha llevado a una serie de aprovechamientos, en dónde no se les paga como personal de trabajo sino como una beca que suele ser baja, que no tiene los derechos laborales que debiera tener un profesional ya recibido que trabaja en ese día a día”, explicó el legislador. Finalmente, sostuvo: “La verdad es que es una preocupación establecida por el Ministerio de Salud de la Nación, y me parece que es un tema que debemos tratar. El proyecto me parece más que interesante para ponerlo en agenda y en el corto tiempo podamos tener una propuesta que tenga el consenso de todas las fuerzas políticas y del Ministerio de Salud para darle garantía a los residentes en el futuro”.
Por último, el senador Mario Fiad celebró la esta posibilidad de que se esté tratando un tema trascendente: “La residencia médica es un modelo de formación de posgrado y remunerativo, con la cual hacía falta una vuelta de rosca para generar derechos, y sin duda alguna la posibilidad de que esos derechos sean progresivos y que llegamos a tener la mejor ley posible en un tema crucial y de sostenimiento de los hospitales públicos”.
“Hoy uno de los grandes problemas que tiene el sector salud es justamente el tema de recursos humanos y debemos incentivar y reforzar para que tengamos el mejor talento humano en Salud. Por eso veo con muy buenos ojos que sigamos tratando el proyecto en comisión y que elaboramos la mejor ley posible”, concluyó el legislador.
